American Express Travel Related Services Company, Inc. (merchant and corporate card products).

American Express does not accept service of subpoenas at any American Express office location.

General Requirements for Processing

Subpoenas must include:

The customer's full name and social security number (full or last 4 digits).
The customer's full name and account number (full or last 6 digits).
The business’ legal name and employer identification number.
The court case number and case style.
The American Express entity served.
The issuer’s signature and date of issuance.
The email address of issuer.
Specific documents requested and a date range.

Subpoenas received with vague requests (i.e. “any and all”), including non-specific time periods, may be challenged or result in limited responses. Additionally, if a date range is not specified, then we will provide the last 6 months of available records from the date we receive the subpoena. Only when we are satisfied that the legal process is valid and appropriate do we deliver the data required to be responsive to the request.

Processing Time

Subpoena fulfillment will take up to 30 calendar days. If extensive information is requested or it is a high-volume period, it may take up to 60 calendar days.

Delivery Method

We use ServePort^™ to deliver fulfillment documents. When your fulfillment documents are ready, you will receive instructions via email from no-reply@serveport.com.

Processing Fees

For delivery by ServePort^™, the expected cost for subpoena fulfillment is usually between $100 - $300, which you can pay via credit card when you log in to download the fulfillment documents.

A flat fee of $85.00 is charged for the intake, review, and electronic delivery of fulfillment documents via ServePort^™.
An additional fee for retrieval of responsive documents is charged, which will be based on the labor charges and volume of records requested.
If there are different governing rates under state/federal law, those rates will be applied.

If records must be delivered by mail, you will be invoiced for labor charges, USB or per page costs, and UPS fees. The invoice is payable within 30 days of receipt of documents.

Additional Documentation

Motions to quash or objections must be received prior to the subpoena return date in order to prevent the release of records. Records will be released only upon receipt of a court order, joint stipulation of the parties, or with the customer's written authorization. We reserve the right to request supporting documentation to determine how the records sought are relevant to the pending litigation or proceeding.
