Eligibility
Amex Round-Up is available to a limited number of consumer Card Members who have an active US-issued AENB Basic Consumer Credit Card (your “Card”) attached to an American Express Online Account (“Online Amex Account”), have an active email address on file with us, and satisfy all other eligibility criteria that may be established by Amex. You may only link Amex Round-up to a single Card. Subject to applicable law, Amex has sole discretion over the eligibility criteria for Amex Round-Up, which may change in the future.
Description of Amex Round-Up Services
General. Amex Round-Up is an automatic payment function attached to your Card that allows you to instruct us to automatically make a charitable contribution from your Card each time you make an eligible transaction with your Card (a “Card Transaction”). Based on your instructions, each time you make an applicable Card Transaction, Amex Round-Up will make a second transaction against your Card that makes a payment into your Impact Account (a “Round-up Transaction”).
Amex Round-Up in your Online Amex Account. You may access Amex Round-Up through your Online Amex Account. In your Online Amex Account, you may select which categories of Card Transactions that you would like to trigger Round-Up Transactions and what amount that you would like the Round-Up Transactions for each category to be. For example, for each category of Card Transactions, you may select Round-Up Transactions to round up the Card Transaction to the next $1, $5 or $10.
Making Round-Up Transactions. Each Round-Up Transaction will automatically make a payment into your Impact Account that is charged to your Card in the amount of the difference between the Card Transaction and amount that you selected to be rounded up for the relevant category of the Card Transaction.
ROUND-UP TRANSACTIONS ARE CREDIT CARD TRANSACTIONS THAT ARE CHARGED AGAINST YOUR CARD, ARE GOVERNED BY YOUR CARDMEMBER AGREEMENT FOR THE RELEVANT CARD, AND ARE SUBJECT TO INTEREST CHARGES AT THE RELEVANT ANNUAL PERCENTAGE RATE FOR THE CARD. AMERICAN EXPRESS CHARGES PHILANTHROPI A PROCESSING FEE FOR ROUND-UP TRANSACTIONS; HOWEVER, YOUR CONTRIBUTION WILL NOT BE REDUCED BY THE FEE PAID BY PHILANTHROPI.
Round-Up Transactions are recorded as separate transactions on the Billing Statement that are distinct from Card Transactions that are rounded up.
Round-Up Transactions may be made on Card Transactions paid in currencies other than U.S. Dollars. Round-Up Transactions will round up the amount of such Card Transactions after they are converted to U.S. Dollars.
Limits to Round-Up Transactions. The aggregate amount of Round-Up Transactions on your Card is limited to $200 each calendar month. You will be able to keep track of the amount of Round-Up Transactions your Card has been charged through the Amex Round-Up on your Online Amex Account. Subject to applicable law, at our discretion, we may accept Round-Up Transactions that exceed this limit and may change the limit at any time.
Timing of Transactions. A Round-Up Transaction will be made when a merchant submits an applicable Card Transaction to us for authorization. In some cases, merchants may later submit an amount for settlement of a Card Transaction that is different than the amount that is originally submitted for authorization. In such case, the Round-Up Transaction will correspond to the original transaction amount. For example, a Card Transaction for a meal at a restaurant may be authorized for the amount of the meal, but submitted for settlement for a higher amount to include a tip that you asked to be added. The Round-Up Transaction for the Card Transaction would be based on the original amount without the tip added.
In other cases, merchants may submit separate Card Transactions to us for related payments. For example, a ride-share company or restaurant may submit one Card Transaction for the cost of a ride or meal and a second Card Transaction for the tip you give for the ride or meal (which is the general practice when the tip amount is greater than 30% of the purchase price, but can happen with any tipped purchase). Other examples may include instances in which you ask a retail merchant to separate items that you purchase together into multiple Card Transactions or in which an online merchant automatically separates items that you purchase together into multiple Card Transactions. In such cases, a Round-Up Transaction will be made on each of the Card Transactions (for example, one Round-Up Transaction will be made to round up the cost of a ride or meal and another Round-Up Transaction will be made to round up the amount of the tip).
Reward Programs. Subject to the agreement governing Membership Rewards or other rewards programs, you may earn Membership Rewards Points or other rewards on Round-Up Transactions. Most rewards programs calculate the rewards that a transaction earns by rounding the transaction to the nearest dollar and, as such, a Round-Up Transaction under $0.50 will generally not earn Membership Rewards Points or other rewards. You are responsible for any taxes that may apply to earning or using Rewards Points or other rewards.
Some rewards programs may offer opportunities to earn additional rewards for Card Transactions of certain transaction types (for example, an offer may be extended in which Card Transactions at grocery stores earn additional rewards). In some cases, Amex Round-Up and rewards programs may classify Card Transactions differently. In such cases, the Card Transaction may fit within a category that you have selected to be rounded-up but not within a similar category that earns additional rewards.
Round-Up Transactions will be separate and distinct transactions from Card Transactions that are rounded up, will appear separately on your Billing Statement, and will have different transaction types than rounded-up Card Transactions. Eligible rounded-up Card Transactions will continue to earn additional rewards based on transaction type. However, Round Up Transactions will not earn additional rewards based on the transaction types of the corresponding rounded-up Card Transactions.
Your Philanthropi Impact Account
To activate enrollment of Amex Round-Up, you must open an Impact Account with Philanthropi using Philanthropi’s Online Portal. Your Impact Account and related services are provided by Philanthropi and will be governed by Philanthropi’s Impact Account Terms and not these Round-Up Terms. It is very important that you review and understand the legal terms that govern your Impact Account and related services provided by Philanthropi as American Express will not be responsible for them.
What is a Donor Advised Fund?. A donor advised fund is a pool of assets owned by a charitable institution that receives advice from donors to the fund regarding how the assets should be used, invested, and granted. A payment into a donor advised fund is a non-revokable charitable contribution that becomes the property of the charity offering the donor advised fund. When the payment in a donor advised fund is completed, the ownership and control of the contributed funds is permanently passed to the charity. A charity that offers a donor advised fund may provide opportunities for donors to advise the charity regarding the contributed funds, including advice on the granting of the fund’s assets to other charitable causes. However, the charity retains final discretion over the fund and, in accordance with the fund’s agreement with donors, the charity may limit, modify or reject advice and instructions given by donors.
Your Philanthropi Impact Account. Your Impact Account is a donor advised fund owned by Philanthropi. When a Round-Up Transaction makes a payment into your Impact Account, the funds become the property of Philanthropi. Subject to Philanthropi’s Impact Account Terms, you may provide advice and instructions to Philanthropi regarding how you would like the contributed funds to be granted to other charitable organizations. However, Philanthropi will retain final discretion regarding funds in your Impact Account and may choose not to comply with your instruction. American Express shall have no liability for Philanthropi’s decisions in regard to funds in your Impact Account, including without limitation, Philanthropi’s use, investment, and granting of such funds. American Express makes no warranty regarding, and shall not be liable for, Philanthropi’s tax status or the tax treatment of your Impact Account or any transactions into or out of your Impact Account.
Philanthropi’s Online Portal. Subject to your agreements with Philanthropi, once your Impact Account is created, you may access information about your Impact Account and provide instructions regarding your Impact Account to Philanthropi through Philanthropi’s Online Portal. Philanthropi’s Online Portal is not owned or controlled by American Express and will be subject to different terms of service and privacy policies than American Express websites. American Express does not guaranty the performance, security, or availability of Philanthropi’s Online Portal. Philanthropi may allow you to sign-in to Philanthropi’s Online Portal using your American Express login credentials. If you unenroll from Amex Round-Up, you will need to establish different credentials with Philanthropi to access Philanthropi’s Online Portal.
Inquiries and Disputes about Round-Up Transactions
IF YOU DISPUTE A CARD TRANSACTION THAT HAS BEEN ROUNDED UP, YOUR DISPUTE WILL APPLY ONLY TO THE CARD TRANSACTION AND NOT TO THE ASSOCIATED ROUND-UP TRANSACTION UNLESS: (I) THE ROUNDED-UP CARD TRANSACTION WAS UNAUTHORIZED; AND/OR (II) AT THE TIME YOU DISPUTE THE CARD TRANSACTION, YOU ALSO REQUEST TO DISPUTE THE ROUND-UP TRANSACTION. UNLESS YOU OTHERWISE DISPUTE THE ROUND-UP TRANSACTION, IT WILL NOT BE PARTIALLY OR FULLY REIMBURSED EVEN IF THE CARD TRANSACTION IS MODIFIED OR REMOVED. SIMILARLY, IF A DISPUTE RESULTS IN A CARD TRANSACTION BEING CHARGED AGAINST YOUR ACCOUNT IN A DIFFERENT AMOUNT THAN THE ORIGINAL CARD TRANSACTION, A NEW ROUND-UP TRANSACTION WILL NOT BE CHARGED.
If you are reimbursed for a disputed Round-Up Transaction, we may elect in our discretion to instruct Philanthropi to reduce your Impact Account by the amount of the reimbursement. Please consult a tax advisor if you have questions about the tax treatment of a refund of a Round-Up Transaction. We cannot provide tax advice to you.
Privacy and Data Usage
Authorization.You agree to the American Express Online Terms of Service and American Express Online Privacy Statement and you authorize us to share information about you with Philanthropi. Information we might share includes: first and last name, email address, phone number, and Card Transaction data relating to your Round-Up Transactions.
Other Policies. Philanthropi has its own terms and conditions and privacy policies and practices applicable to Impact Accounts and the Philanthropi’s Online Portal that govern its use and disclosure of information about its customers. If you have a question or issue with your Impact Account or the manner in which Philanthropi uses your information, please contact Philanthropi.
Third Party Agreements
Claims
Any current or future claims, disputes or controversy relating to your use of Amex Round-Up, as it relates to our provision of services for Amex Round-Up, shall be governed by the Claims Resolution section of your relevant Cardmember Agreement, which includes an arbitration provision.
Modification and Termination
Entire Agreement
Round-Up Transactions are transactions against your Card that are governed by the relevant Cardmember Agreement.
These Round-Up Terms and other applicable American Express Agreements set forth the entire understanding and agreement between you and us, whether written or oral, with respect to Amex Round-Up and supersede any prior or contemporaneous understandings or agreements with respect to such subject matter.
