Legal terms for use of the Internet site of American Express, spol. s r.o. at the address www.americanexpress.cz (hereinafter referred to as the “Terms”)

American Express, spol. s r.o., (hereinafter referred to as “American Express”) requests the visitors of its site on the Internet (hereinafter referred to as the “Website”) to comply with these Terms. Entering the Website, you confirm that you have become acquainted with the Terms and accept them.

Legal Regulations

The user's access to the Website and its use is governed by relevant legal regulations and these Terms.

Copyright/Trademarks

Trademarks, logos and service marks (hereinafter referred to as the “Marks”) displayed on the Website and any rights to use them are the property of American Express and other parties. The use of all Marks, including the use thereof in the form of “metatags” for any purpose, is prohibited for all users of the Website without the prior written consent of American Express or the relevant third party owning the Mark. All information and content, including all software programmes available on the Website (hereinafter referred to as the “Content”), are protected by intellectual property rights. The users are prohibited in any manner whatsoever to modify, copy, distribute, transfer, display, publish, sell, license, create any non-original work on the basis of or otherwise use the Content for commercial and public purposes.

ANY CONTENT OF THE WEBSITE IS PROVIDED IN THE FORM “AS PRESENTED” BY THE PARTIES WITHOUT ANY WARRANTIES. AMERICAN EXPRESS IS NOT LIABLE FOR ANY OPINION, ADVICE OR POSITION PRESENTED BY OTHER PARTIES VIA THE WEBSITE AND BEARS NO RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY THEREOF. IT IS UP TO THE USER TO HIMSELF ASSESS THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY OPINION, ADVICE OR OTHER CONTENT AVAILABLE ON THE WEBSITE. IF REQUIRED, WHILE MAKING ASSESSMENT OF ANY SPECIFIC OPINION, ADVICE OR OTHER CONTENT, PLEASE, CONSULT PROFESISONALS. Protection of Confidential Communication with User

American Express shall maintain and treat all communication containing the user's personal data and transferred directly by American Express as confidential in compliance with legal regulations and the American Express Policy of Data Protection and Privacy, with the exceptions provided by legal regulations and these Terms.

Any communications published by the user via discussion forums are not deemed to be confidential information. American Express is entitled at its own discretion to use and disclose to is parent and subsidiary companies and branch offices any information contained in any communication within the discussion forum, except for the information protected by legal regulations.

Linked Websites

American Express bans caching (temporary storage on a hard disc), unauthorized hypertext links to the Website and any linkage to the Content available on the Website. American Express is entitled to block any unauthorized links or linkage and is not liable for the Content available on any other websites linked to the Website. The user enters any website linked to the Website at his own risk.

Communications

(For use in connection with the area intended for communication and discussion forums on the Website) American Express is not obliged to control all communications, information or content (hereinafter referred to as the “Communications”) published on the Website and is not liable for that. American Express has the right to control the communications on the Website and restrict acceptance of and/or delete the Communications (and/or any part thereof) which include: any information or materials in breach of any legal regulations; any harmful, threatening, defamatory, grievous, abusive, vulgar, indecent, rude or hateful materials, those impermissible in terms of race, ethnic origin or otherwise; any materials instigating to commit a criminal or minor offence; advertising and promotion of any kind (Note: This does not concern the Website's subsections the space of which is intended for communications containing advertisements); any communications published by the users and personifying another person, any personal data, such as telephone number, bank account number, residential address, employee assessment prepared by employer, etc.; any communications of American Express employees acting on behalf of American Express without being authorized thereto, any communications offering to download unauthorized products protected by legal regulations (in particular by copyright) or constituting confidential information; repeated communications placed in individual sections by an identical user with an identical content, chain letters of any kind.

Alterations to the Terms

American Express is entitled at any time to alter any provisions of these Terms provided that it notifies its users of any such alterations.

Breach of the Terms

American Express is entitled to use all statutory means, including the right to block access to the Website from a particular Internet address in case of breach of legal regulations.

Access to Password Protected/Secured Areas

Access to password protected/secured areas and/or their use is only reserved for authorized users. Unauthorized attempts of individuals to obtain access to such areas of the Website may become subject to penalty under a legal regulation.

Use of “COOKIES”

American Express reserves the right to store information in form of “cookie” or other similar form in the user's computer to modify the Website in an attempt to meet user preferences. Governing Law/Jurisdiction

This Website is governed by relevant legal regulations of the Czech Republic (in particular by the Copyright Act, the personal data protection regulations and the Civil Code).
