The American Express® Gold Card
Updates to your Card Terms and Conditions
The new Terms and Conditions below on your American Express® Gold Card will replace your previous Terms and Conditions from 1 November 2023. Our updates aim to make our Terms and Conditions clearer and fairer.
Please note that none of these changes impact the fees and charges on your Card or the benefits connected to your Card.
Charge Card Member Agreement

Sections - Lost and Stolen Cards and Misuse of Your Account & When you are liable for unauthorised charges:
- Moved sections 22 & 23 to sections 3 & 4.
- Sections 3 through 21 moved. (e.g. section 3 is now section 5 & section is 21 now 23).
- Sections 24 through 37 have not moved.
Section 2 - Protecting your Account, and Use of your Card(s)/Codes:
- Highlighted responsibility of the Card Member to notify American Express of a lost or stolen Card, which may make a Card Member liable for unauthorised Charges.
Section 6 - Right to Change Fees, Liquidated Damages and Commissions:
- Added the following paragraph -
You agree that we may impose additional fees and commissions by giving you at least 30 days' advance written notice.
You may also be entitled to a refund of your annual fee in certain circumstances. If you are ending this Agreement because you do not agree with changes we are making to this Agreement and those changes are detrimental to you, we may give you a pro-rated refund of your annual fee provided you give us notice that you intend to end your Agreement within 30 days of us telling you about the relevant changes to this Agreement.
Section 7 - Additional Card Member not liable for Charges:
- Removed reference to implementation date of 1 June 2011.
Section 8 – Charge Approval:
- Changed ‘credit limit’ to ‘spending limit’.
Section 28 - You May Close Your Account:
- Added the following paragraph -

Updated “Supplementary” Cardmember to “Additional” Cardmember.
Section 2 - Eligibility and Enrolment:
- You cannot pool or combine your points with points accrued in another Program Account. Added a sentence to clarify if you hold more than one Account and voluntarily cancel any such Account and at least one Account remains open, we may allow points accrued to be linked to the open Account.
Section 5 - Points Accrual - Exclusions:
- Clarified that you cannot accrue points for fund disbursements.
Section 10 - Redeeming Points for Credit:
- Added the following paragraph -
The redemption of points for a credit to your Card (Points for Credit) will be administered by us within three business days and cannot be reversed. Amounts credited will appear on the first monthly statement following redemption. If you hold multiple Cards linked to the one Membership Rewards account, the Points for Credit redemption will automatically be credited to the Primary Account only.
Section 13 - Redeeming Frequent Traveller Rewards:
- 13.2 – You may only redeem Points into a participating Frequent Traveller Program(s) in your name. Removed reference to ‘Points transferred to a Frequent Traveller Program Account in any other name will be returned to your Program Account.’
Section 14 - Program Account:
- Added 'Where we have reasonable grounds,' to Clause 14.6 per following paragraph -
Where we have reasonable grounds, we reserve the right to withdraw all Card benefits from you and any Supplementary Card Member due to the failure of you or the Supplementary Card Member to adhere to the conditions applicable to any Card.
Section 17 - Privacy and Personal Information:
- Clarified information on how to opt-out of direct marketing per following paragraph -
You can opt-out from receiving direct marketing at any time by calling 1300 132 639. You can also adjust your communication preferences using our Online Preferences or opt-out of email marketing by clicking ‘unsubscribe’ in the footer of our emails.
American Express Travel Online Terms and Conditions

Section 4 - Law and Jurisdiction:
- Clarified the jurisdiction of the Terms and Conditions of use of the American Express website, per below paragraph -
These Terms and Conditions and your use of the American Express website is governed by the laws of the State or Territory of Australia as stated on your billing address or if your billing address is overseas, as stated on your last known Australian billing address and the courts of that State or Territory shall have jurisdiction over all parties to the Agreement.
Section 31 - Payment Method:
- 31.1 - Removed 'Available only for pre-paid products' in relation to payment using 'Authorisation to Charge' forms.
- 31.2 - Updated Travel Credit payment method Terms to align with Travel Credit Terms found here. Including clarification around changes or cancellations to bookings, certain booking-type eligibility, unused Travel Credit[s], cancellation or changes to Card or Rewards program[s] and if your account is enrolled in the Care or Financial Relief Program and your Card has been temporarily deactivated, you will not be able to use the Travel Credit until you exit the relief program and re-activate your Card.
Flexible Payment Option (FPO) Agreement*
*Applicable to currently enrolled Card Members only. Flexible Payment Option is not available for new enrolments.

Section 5 - Fees:
- Clarified terms relating to notice on changes to this Agreement as per below –
We will give you at least 30 days’ advance written notice for any changes to this Agreement, except where the change reduces what you have to pay (or is otherwise in your favour) or the change happens automatically under the contract. If you are dissatisfied with any change to this Agreement, you may cancel your FPO facility as set out under the ‘You May Close Your FPO facility’ section of this Agreement.
Section 8 - Interest:

For the avoidance of doubt, all charges and amounts billed to your account over the FPO limit will be due in full in accordance with your Linked Charge Card account agreement and will not incur interest.
